1. Agreement to Terms

By accessing and using Empire by Design™ ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform. These terms apply to all users, including but not limited to founding members and regular subscribers. 

2. Service Description

What Empire by Design Provides

Empire by Design is an AI-powered business coaching platform that provides: 

  • Personalized business strategy and coaching powered by Claude AI
  • Human Design chart calculations and interpretations
  • Astrological insights and business guidance
  • Document analysis and content generation tools
  • Brand Vault for storing and organizing business documents
  • Integration of Karla Maree's business frameworks and methodologies

What Empire by Design Does NOT Provide

Empire by Design is NOT: 

  • A replacement for professional business, legal, financial, or tax advice
  • A guarantee of business success or specific results
  • Licensed therapy, counseling, or mental health services
  • A substitute for professional medical or psychological advice
  • Guaranteed astrological or divination services

3. User Responsibilities and Conduct

ACCOUNT ACCESS

You are responsible for: 

  • Maintaining the confidentiality of your access code
  • All activity that occurs under your account
  • Immediately notifying us of any unauthorized access
  • Not sharing your access code with unauthorized parties

PROHIBITED CONDUCT

You agree NOT to: 

  • Use the Platform for any illegal or fraudulent purpose
  • Attempt to reverse-engineer, hack, or compromise the Platform's security
  • Resell or redistribute access to the Platform without authorization
  • Use automated tools, bots, or scripts to access the Platform
  • Upload or distribute malicious code, viruses, or harmful content
  • Harass, threaten, or abuse other users
  • Submit false or misleading information
  • Violate any applicable laws or regulations

4. Intellectual Property Rights

PLATFORM OWNERSHIP

Empire by Design™, all platform content, features, functionality, and design are the proprietary property of Iconic Empire by Karla Maree. This includes but is not limited to: 

  • The Human Design system integration
  • Karla Maree's business frameworks and methodologies
  • All system prompts, coaching models, and AI configurations
  • Brand identity, trademarks, and logos
  • All software code and database infrastructure

YOUR CONTENT

You retain ownership of any content you create or upload to the Platform ("Your Content"), including business information, documents, and uploaded files. By uploading Your Content, you grant Empire by Design a non-exclusive, royalty-free license to: 

  • Store and process Your Content
  • Use Your Content to provide coaching and analysis
  • Improve our Platform and AI models
  • Analyze anonymized usage patterns (without sharing Your Content with third parties)

AI-GENERATED CONTENT

Content generated by the AI on the Platform (coaching advice, strategies, content recommendations) may be used by you for your business. Empire by Design makes no warranties regarding the originality, uniqueness, or non-infringement of AI-generated content. You are responsible for verifying its accuracy and appropriateness for your business. 

5. Disclaimers and Limitations of Liability

DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED AS IS; WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. EMPIRE BY DESIGN AND ICONIC EMPIRE BY KARLA MAREE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: 

  • Warranty of merchantability
  • Warranty of fitness for a particular purpose
  • Warranty of non-infringement
  • Warranty of accuracy or completeness of information
  • Any guarantee of uninterrupted or error-free service

NO PROFESSIONAL ADVICE

The Platform provides general guidance and is NOT a substitute for professional advice. While Empire by Design may provide business coaching and strategy recommendations, you should consult with licensed professionals (business advisors, attorneys, accountants, financial advisors) before making significant business or financial decisions. 

NO GUARANTEE OF RESULTS

Empire by Design does not guarantee any specific business outcomes, revenue targets, customer acquisition, or success metrics. Results vary based on your individual circumstances, efforts, market conditions, and countless other factors beyond the control of the Platform. 

AI LIMITATIONS

AI-generated coaching and content may contain inaccuracies, outdated information, or incomplete advice. You are responsible for: 

  • Verifying all information before acting on it
  • Fact-checking recommendations
  • Using professional judgment before implementing advice

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ICONIC EMPIRE BY KARLA MAREE OR EMPIRE BY DESIGN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO: 

  • Loss of revenue or business opportunities
  • Loss of profits or financial harm
  • Loss of data or information
  • Reputational harm
  • Any other damages arising from service interruption or unavailability

THE TOTAL LIABILITY OF ICONIC EMPIRE BY KARLA MAREE FOR ANY CLAIM RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

6. Pricing, Payment, and Refunds

PRICING

Founding members receive lifetime access at a locked rate of $29/month (charged monthly) as long as your subscription remains active. Future members will be charged $49/month. Prices are subject to change with 30 days' notice. 

BILLING

Subscriptions renew automatically each month. You are responsible for providing accurate billing information and notifying us of any changes. Failed payments may result in service suspension. 

REFUND POLICY

All subscriptions are non-refundable. You are in charge of managing and tracking this subscrdiption.  However, you may cancel your subscription at any time, and you will not be charged for subsequent months. If you believe there has been a billing error, please contact us within 7 days of the charge - otherwise we cannot honour a refund.

7. Cancellation and Termination

USER CANCELLATION

You may cancel your subscription at any time. Cancellation is effective at the end of your current billing period. No refunds are issued for partial months. 

Termination by Empire by Design

We reserve the right to terminate or suspend your access to the Platform if you: 

  • Violate these Terms and Conditions
  • Engage in prohibited conduct
  • Attempt to abuse or exploit the Platform
  • Fail to pay your subscription fees

Termination will result in immediate loss of access to your account and all data stored on the Platform. See our Privacy Policy for details on data deletion.

8. Fair Use and API Limits

While founding members receive unlimited usage, we reserve the right to enforce fair use policies to maintain platform stability and protect against abuse. Prohibited uses include: 

  • Automated requests or bot activity
  • Reselling access or sharing credentials
  • Excessive requests designed to cause system strain
  • Using the Platform for commercial resale without authorization

9. Third-Party Services and Links

Empire by Design uses third-party services including Anthropic's Claude API, Supabase, and various data providers. Your use of these services is subject to their terms and conditions. We are not responsible for: 

  • Third-party service availability or performance
  • Data handling by third parties
  • Any issues arising from third-party service failures

10. Modification of Terms

We may update these Terms and Conditions at any time. Material changes will be communicated via email or in-app notification. Your continued use of the Platform after changes indicates acceptance of the updated terms. For founding members, price increases are prohibited for the duration of your active subscription. 

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these terms shall be conducted exclusively in the courts located in [Your Jurisdiction], and you hereby consent to the personal jurisdiction and venue of such courts.
